Website Terms and Conditions

1. Acceptance of These Terms

These Website Terms and Conditions ("Terms") govern your access to and use of the website, online forms, landing pages, booking inquiry pages, payment links, digital content, downloadable materials, social media links, event pages, and online services operated by Vibe and Voyages LLC ("Company," "we," "us," or "our").

By visiting the website, submitting an inquiry, creating an account, making a payment, downloading materials, joining a waitlist, registering for an event, booking travel, or using any online feature connected to Vibe and Voyages LLC, you agree to these Terms and any additional agreements, policies, supplier terms, invoices, forms, waivers, or notices that apply to your transaction.

If you do not agree with these Terms, do not use the website, submit information, make a payment, or book services through the Company.

2. Relationship to Other Agreements

These Terms are intended to work together with other Vibe and Voyages LLC documents, including but not limited to:

• Client Service Agreement and Travel Terms and Conditions;

• Planning Fee Agreement;

• Cancellation and Refund Policy;

• Group Travel Agreement;

• Photo, Video, and Media Release;

• Website Privacy Policy;

• Trip-specific proposals, invoices, payment schedules, passenger agreements, and waivers;

• Supplier, vendor, host agency, insurance, resort, cruise, airline, tour operator, transportation, and destination terms.

If there is a conflict between these Terms and a more specific signed agreement or supplier policy, the more specific agreement, stricter payment requirement, or applicable supplier policy may control.

3. About Our Services

Vibe and Voyages LLC may provide travel planning, travel consulting, group travel coordination, destination event planning, itinerary design, supplier coordination, travel research, event support, digital resources, educational content, and related services.

The website may allow visitors or clients to request quotes, submit trip details, join waitlists, purchase planning services, make deposits, complete traveler forms, sign agreements, register for events, view travel information, or communicate with the Company.

Website information is for general informational and promotional purposes only. A trip, package, rate, room, cruise cabin, excursion, event space, transportation option, or service is not confirmed until all required steps are completed, required payments are processed, supplier confirmation is received, and applicable agreements are accepted.

4. Eligibility and Authority to Use the Website

You must be at least 18 years old to make purchases, submit payment, enter agreements, book travel, or register for paid services through the website. If you submit information for another traveler, minor, household member, group member, employee, guest, or participant, you represent that you have authority to provide that information and accept applicable terms on their behalf.

The Company may refuse service, cancel access, decline a booking, reject an inquiry, or discontinue communication if we believe a person has provided false information, violated these Terms, created safety concerns, abused staff or other travelers, misused payment systems, or created legal, financial, reputational, or operational risk.

5. Accuracy of Information You Provide

You are responsible for submitting complete, accurate, and current information. This includes legal names, dates of birth, passport information, contact information, payment information, travel dates, destination preferences, accessibility needs, dietary needs, roommate preferences, emergency contacts, and any other information required for planning or booking.

Vibe and Voyages LLC is not responsible for denied boarding, supplier rejection, reservation errors, price changes, cancellation penalties, travel document issues, name mismatch fees, late fees, missed deadlines, or other losses caused by inaccurate, incomplete, outdated, or late information supplied by you or your group members.

6. Quotes, Pricing, Availability, and Website Content

Travel pricing and availability are subject to change without notice. Quotes displayed on the website, in marketing materials, by email, through payment links, on social media, or in proposals are not guaranteed until required payments are made, supplier confirmation is received, and all booking terms are accepted.

Website content may include destination descriptions, promotional language, sample itineraries, estimated pricing, event concepts, travel inspiration, package examples, photographs, videos, testimonials, and educational materials. Such content is not a guarantee of specific results, availability, supplier performance, travel conditions, personal experience, savings, upgrades, or trip outcomes.

The Company may correct errors, update pricing, revise descriptions, remove content, change offers, close registration, or cancel promotions at any time, subject to applicable law and any binding written agreement already in effect.

7. Payments, Planning Fees, and Travel Deposits

Payments made through the website, payment links, invoices, checkout pages, third-party processors, or other approved channels may include planning fees, consultation fees, trip deposits, event deposits, installment payments, supplier payments, package payments, administrative fees, cancellation fees, or other charges.

Planning fees and professional service fees compensate Vibe and Voyages LLC for time, expertise, research, itinerary design, vendor communication, proposal preparation, coordination, and administrative support. Unless expressly stated in writing, planning fees are separate from supplier payments and are non-refundable once work begins or once the fee is paid, whichever occurs first.

Website Terms and Conditions | Client-Facing Publication Version

Travel deposits and supplier-related payments may be subject to non-refundable and non-transferable supplier terms. The Company may collect payments directly, facilitate payments to a supplier or host agency, or direct clients to pay suppliers directly, depending on the service or trip.

The Company does not treat client travel funds as earned Company revenue unless and until the funds are legally and contractually earned. Client funds may be tracked separately from operating funds in accordance with Company policy, supplier requirements, and applicable law.

8. Payment Authorization, Processing Fees, and Taxes

By submitting payment information, you authorize the Company and its approved payment processors to charge the amount shown, including any applicable fees, taxes, installments, processing charges, late fees, cancellation charges, administrative fees, or other authorized amounts.

You agree not to use unauthorized payment methods, false billing information, stolen cards, disputed cards, or third-party payment information without permission. You are responsible for any payment processor fees, bank fees, insufficient fund charges, chargeback fees, or collection costs caused by your payment activity to the fullest extent permitted by law.

Taxes, government fees, resort fees, port fees, service charges, destination fees, and other charges may change and may be added by suppliers, vendors, processors, or government authorities.

9. Cancellations, Refunds, Transfers, and Chargebacks

All cancellations, refunds, transfers, payment disputes, and chargebacks are governed by the applicable Vibe and Voyages LLC Cancellation and Refund Policy, Client Service Agreement, Planning Fee Agreement, Group Travel Agreement, supplier terms, insurance policy, payment processor rules, and trip-specific terms.

Cancellation requests must be submitted in writing. Verbal statements, social media messages, failure to pay, failure to respond, or non-attendance do not automatically cancel a booking unless accepted in writing by the Company.

Before filing a chargeback or payment dispute, you agree to contact the Company in writing and allow a reasonable opportunity for review and resolution. Filing a chargeback does not automatically cancel your contractual obligations or guarantee a refund.

10. Independent Suppliers and Third-Party Providers

Vibe and Voyages LLC may work with independent suppliers, vendors, hosts, resorts, hotels, cruise lines, airlines, tour operators, transportation providers, excursion companies, event venues, restaurants, photographers, payment processors, insurance providers, and technology platforms.

These third parties are not owned or controlled by the Company unless expressly stated in writing. The Company is not responsible for supplier acts, omissions, delays, cancellations, schedule changes, safety issues, overbooking, service failures, insolvency, policy changes, denied service, refund decisions, or any loss caused by a third-party provider.

Website Terms and Conditions | Client-Facing Publication Version

Supplier terms may include restrictions, cancellation penalties, non-refundable deposits, name-change fees, travel document requirements, health requirements, age restrictions, behavior rules, and risk waivers. You are responsible for reviewing and complying with all supplier terms.

11. Travel Documents, Entry Requirements, and Traveler Responsibility

You are responsible for confirming all travel requirements before departure, including passports, visas, identification, vaccination or health requirements, entry forms, customs rules, airline rules, cruise rules, resort rules, baggage requirements, minor travel consent forms, and destination-specific restrictions.

The Company may provide reminders or general information as a courtesy, but the client remains responsible for verifying current requirements with official government sources, airlines, cruise lines, suppliers, and destination authorities.

No refund is owed by Vibe and Voyages LLC for denied boarding, denied entry, missed departures, expired documents, name mismatches, passport delays, visa denials, incomplete forms, missed deadlines, or failure to comply with travel requirements.

12. Travel Insurance

Vibe and Voyages LLC strongly recommends that all travelers purchase comprehensive travel insurance. Travel insurance may help protect against losses related to cancellation, interruption, delay, medical emergencies, emergency evacuation, baggage loss, supplier default, illness, injury, severe weather, and other covered events, depending on the policy purchased.

If you decline travel insurance, you accept the financial risk of cancellation, delay, interruption, illness, injury, emergency, non-refundable travel costs, and supplier refusal to issue refunds. Declining insurance does not create a refund obligation for the Company.

13. User Conduct and Prohibited Uses

You agree to use the website only for lawful purposes and in a manner that does not harm the Company, its clients, suppliers, vendors, staff, contractors, travelers, technology systems, or reputation.

You may not:

• submit false, misleading, incomplete, or fraudulent information;

• use the website to harass, threaten, abuse, stalk, defame, or exploit others;

• attempt to gain unauthorized access to systems, forms, payment tools, databases, client information, or accounts;

• copy, scrape, reverse engineer, download, reproduce, or misuse website content without permission;

• upload malware, spam, harmful code, or disruptive content;

• interfere with website security, functionality, or availability;

• use Company forms, content, proposals, itineraries, photos, videos, policies, or intellectual property to compete with or impersonate the Company;

• file false payment disputes, use unauthorized cards, or attempt to avoid valid payment obligations.

14. Intellectual Property

The website and its content, including text, images, graphics, logos, icons, videos, itineraries, proposals, planning tools, templates, forms, policies, designs, branding, trade names, digital products, educational materials, and marketing content, are owned by or licensed to Vibe and Voyages LLC unless otherwise stated.

You may view and use website content for personal, non-commercial purposes related to evaluating or purchasing Company services. You may not copy, reproduce, publish, sell, license, modify, distribute, repost, or create derivative works from Company content without written permission.

Client-specific proposals, itineraries, timelines, group plans, destination concepts, and vendor recommendations remain Company work product unless otherwise agreed in writing.

15. User Content, Reviews, Testimonials, and Submissions

If you submit reviews, comments, testimonials, photographs, videos, social media posts, feedback, suggestions, survey responses, or other content to the Company or tag the Company online, you grant Vibe and Voyages LLC a non-exclusive, worldwide, royalty-free right to use, repost, display, edit, publish, and share that content for business, marketing, educational, promotional, and testimonial purposes, subject to applicable law and any written opt-out or limitation accepted by the Company.

You represent that you own or have permission to submit any content you provide and that your content does not violate another person’s rights, privacy, copyright, trademark, publicity rights, or confidentiality obligations.

The Company may remove, decline, edit, or refuse user-submitted content at its discretion.

16. Photo, Video, and Media Use

Participation in Company events, group trips, hosted experiences, destination events, retreats, meetings, or promotional activities may involve photography, videography, audio recording, social media content, interviews, testimonials, and other media capture.

Media use is governed by the Vibe and Voyages LLC Photo, Video, and Media Release and any trip-specific media notice or opt-out process. If you do not want your likeness used, you must submit a written limitation request before the event or trip when practical. The Company will make reasonable efforts to honor written limitations but cannot guarantee control over images or videos captured by other guests, travelers, vendors, venues, media outlets, or public platforms.

17. Privacy and Data Security

Your use of the website is also governed by the Vibe and Voyages LLC Website Privacy Policy. The Privacy Policy explains how the Company may collect, use, share, safeguard, and retain personal information, including inquiry information, traveler details, payment records, passport-related information, preferences, analytics data, and marketing information.

No website, payment system, email system, form, cloud platform, or transmission method is guaranteed to be completely secure. You agree to use secure methods when submitting sensitive information and to notify the Company promptly if you believe your information was submitted incorrectly or accessed without authorization.

18. Email, SMS, and Marketing Communications

By submitting your contact information, joining a list, downloading materials, registering for an event, submitting an inquiry, or making a purchase, you may receive transactional messages related to your inquiry, booking, payment, trip, event, or account.

If you opt in to marketing communications, you may also receive newsletters, promotions, event announcements, travel opportunities, group trip updates, reminders, and related messages. You may unsubscribe from marketing emails using the unsubscribe link or by contacting the Company. Transactional messages may continue as needed to service your booking, inquiry, payment, or legal obligations.

Text messaging, if used, may be subject to carrier fees and separate consent language. You may opt out of promotional text messages by following the opt-out instructions provided in the message or by contacting the Company.

19. Third-Party Links, Tools, and Platforms

The website may link to or integrate with third-party platforms, including payment processors, booking tools, host agencies, travel suppliers, social media platforms, email marketing services, form tools, analytics tools, insurance providers, event platforms, and affiliate links.

The Company does not control third-party websites, platforms, policies, fees, security practices, availability, or content. Your use of third-party platforms may be governed by their own terms and privacy policies.

Affiliate links, referral links, or supplier links may generate compensation to the Company, where permitted by law and applicable supplier terms.

20. Website Availability, Errors, and Security

The Company works to maintain accurate and useful website content, but does not guarantee that the website will be uninterrupted, error-free, secure, virus-free, current, or available at all times.

The Company may update, suspend, discontinue, restrict, or modify any website feature, content, form, offer, landing page, payment link, or service at any time without notice, subject to applicable law and binding written agreements already in effect.

21. Accessibility

Vibe and Voyages LLC aims to provide a website experience that is usable and accessible. If you experience difficulty accessing website content, forms, documents, or services, contact us at [Insert accessibility/contact email] and describe the issue, the page involved, and the assistance needed.

Accessibility-related communications do not change payment deadlines, supplier deadlines, cancellation policies, travel requirements, or contractual obligations unless the Company agrees in writing or applicable law requires otherwise.

22. Disclaimer of Warranties

The website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Vibe and Voyages LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted service.

The Company does not guarantee that the website, travel information, destination descriptions, supplier information, promotional materials, or online tools will be error-free, complete, current, or suitable for your specific needs.

23. Limitation of Liability

To the fullest extent permitted by law, Vibe and Voyages LLC, its owner, members, managers, employees, contractors, advisors, hosts, representatives, affiliates, and service providers shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages arising out of or related to website use, website errors, third-party suppliers, travel disruptions, payment disputes, technology failures, or reliance on website content.

To the fullest extent permitted by law, the Company’s total liability for claims arising from use of the website shall not exceed the amount you paid directly to Vibe and Voyages LLC for the specific website-related service giving rise to the claim, excluding amounts paid to suppliers, vendors, host agencies, processors, insurers, or other third parties.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the Company’s liability will be limited to the maximum extent permitted by law.

24. Indemnification

You agree to defend, indemnify, and hold harmless Vibe and Voyages LLC, its owner, members, managers, employees, contractors, advisors, hosts, representatives, affiliates, and service providers from and against claims, damages, losses, liabilities, costs, fees, and expenses, including reasonable attorney fees, arising from or related to:

• your use or misuse of the website;

• your violation of these Terms or any related agreement;

• false, incomplete, inaccurate, or unauthorized information you provide;

• your violation of supplier, vendor, event, destination, travel, payment, or legal requirements;

• your content submissions, testimonials, reviews, photos, videos, or social media posts;

• your payment disputes, chargebacks, unauthorized transactions, or failure to pay amounts owed;

• your conduct during any trip, event, meeting, hosted experience, or related activity.

25. Force Majeure

Vibe and Voyages LLC is not liable for delay, cancellation, interruption, inability to perform, website unavailability, trip disruption, event disruption, supplier failure, or loss caused by events outside its reasonable control. This includes weather, hurricanes, natural disasters, pandemics, epidemics, government actions, border closures, airport closures, strikes, labor disputes, war, terrorism, civil unrest, supplier bankruptcy, technology failures, power outages, platform outages, cyber incidents, illness outbreaks, acts of God, and other emergency conditions.

26. Governing Law, Venue, and Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, unless applicable law requires otherwise.

Before filing a legal claim, you agree to contact Vibe and Voyages LLC in writing and attempt to resolve the issue informally. If the matter cannot be resolved informally, the parties agree to attempt mediation in good faith before pursuing litigation, arbitration, or other formal action, unless emergency relief, small claims, collection activity, or applicable law requires otherwise.

Any court action arising out of or related to these Terms, the website, or website-related services shall be brought in the state or federal courts located in or serving Will County, Illinois, unless a different venue is required by law or a separate written agreement controls.

The Company may seek injunctive relief, equitable relief, collection of unpaid amounts, enforcement of intellectual property rights, or protection against unauthorized use of its content in any court of competent jurisdiction.

27. Changes to These Terms

The Company may update these Terms at any time. The updated version will be posted on the website with a revised effective date or last updated date. Continued use of the website after changes are posted means you accept the updated Terms.

Material changes that affect active client bookings may also be addressed through trip-specific notices, updated agreements, emails, invoices, or supplier communications.

28. Termination or Restricted Access

The Company may suspend, restrict, or terminate access to the website, forms, payment links, client portals, group communications, or services if a user violates these Terms, fails to pay, misuses the website, files improper disputes, threatens or harasses others, creates safety concerns, or creates legal, reputational, financial, or operational risk.

29. Severability and Waiver

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions remain in full force and effect. The Company’s failure to enforce a provision does not waive the right to enforce that provision later.

30. Entire Terms for Website Use

These Terms, together with the Privacy Policy and any applicable signed agreements, invoices, forms, policies, trip-specific terms, supplier terms, and waivers, form the agreement governing your website use and related
